A Harris County jury has awarded $6.5 million to electrician Mark Miller, who suffered severe head, neck, and back injuries after being struck by a coworker and tumbling down a stairwell. The verdict concludes years of litigation against general contractor CIVE, Inc. regarding site safety and worker supervision protocols.

The incident occurred when Miller was hit in the head with a hammer by another worker, rendering him unconscious and causing a fall through a dimly lit construction stairwell. Legal counsel for the plaintiff argued that the project suffered from systemic negligence, specifically citing a failure to monitor dangerous behavior and maintain basic safety standards for those on-site. CIVE, Inc. defended the case with a team of over a dozen attorneys from the Houston-based firm Ahmad, Zavitsanos & Mensing.

Trent Shelton, the lead trial attorney for Arnold & Itkin, emphasized that the verdict reflects the long-term impact of the injuries on Miller’s life. The trial underscored the legal obligation of general contractors to ensure a secure environment, moving beyond mere suggestions to enforceable safety requirements.
