The lawsuit, filed against the company listed on the NYSE as HIMS, centers on claims that the firm provided materially false or misleading information throughout the specified class period. Plaintiffs allege that Hims failed to disclose the sharing of sensitive consumer health information with third-party advertising platforms and obscured its billing practices regarding medical consultations. According to the complaint, the company represented that consumers would consult with providers to find appropriate treatments, yet allegedly charged for prescriptions almost immediately after intake forms were submitted.
These disclosures, the suit contends, subjected the company to regulatory scrutiny and potential financial penalties, ultimately damaging investors when the information reached the market. The Rosen Law Firm, which is representing the interests of the class, notes that while the litigation is active, no class has been formally certified. Investors retain the right to select their own counsel or remain absent members of the class. Those seeking to serve as a lead plaintiff must file a motion with the court before the November deadline.
