Gildan Activewear Drops Exclusive Pricing After FTC Antitrust Inquiry

Federal regulators have forced Gildan Activewear to abandon restrictive pricing clauses in its distribution agreements, effectively ending an antitrust probe into price discrimination. The investigation scrutinized the apparel giant’s relationship with wholesale distributor S&S Holdings, which had effectively barred competitors from accessing standard market discounts.

The Federal Trade Commission launched the inquiry after identifying contract terms that prevented Gildan from offering equivalent pricing to other wholesale distributors. By mandating that these exclusive terms be stripped from the S&S Holdings contract, the commission aimed to restore competitive balance in the apparel supply chain. Under federal antitrust law, companies are strictly prohibited from engaging in practices that facilitate price discrimination among distributors. Following the formal agreement to amend these distribution terms, the FTC has officially closed its investigation into the matter.
