Nexfibre opted against submitting a remedies package to the watchdog, asserting that the CMA’s current stance relies on unrealistic counterfactuals. The company specifically challenged the regulator’s suggestion that a merger between Netomnia and rival CityFibre would serve as a more competitive market outcome. According to Nexfibre, this assumption lacks credibility and fails to account for the financial scale required for such fiber infrastructure projects.
While the CMA invited third-party feedback on potential concessions by October 27, Nexfibre maintained that no package could satisfy the regulator's existing framework. The watchdog, which launched its formal probe in June, previously warned that the deal could dampen competition in the wholesale fixed broadband market. Nexfibre countered that the billions of pounds in investment enabled by the acquisition would not materialize under the alternative scenarios proposed by officials.
